Moments Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Moments Memory Books, LLC's website, project tools, contributor flows, checkout, printing, and support channels (collectively, the "Service"). In these Terms, "Moments," "we," "us," and "our" refer to Moments Memory Books, LLC. "You" refers to any visitor, project owner, contributor, recipient, or other person using the Service.
By accessing or using the Service, or by affirmatively accepting these Terms where prompted, you agree to these Terms. If you do not agree, do not use the Service.
Changes to These Terms
We may update these Terms to reflect changes to the Service, our operations, or applicable law. We will publish each new version at /terms with a new version number and effective date. Continued use of the Service after updated Terms take effect, or a new affirmative acceptance when we require one, means that you accept the updated Terms. Earlier versions are retained in our policy history.
Eligibility and Authority
You must be at least 18 years old or the age of majority where you live to create an owner account, create a project, or place an order. If you use the Service for an organization, you represent that you have authority to bind that organization to these Terms.
Contributors may submit content only with appropriate permission from a parent or guardian when required by law. You may not use the Service where doing so is prohibited by applicable law.
Accounts, Projects, and Contributor Links
You are responsible for keeping your account credentials secure and for activity under your account. Notify us promptly at support@momentsmemorybooks.com if you believe your account has been accessed without authorization.
A project owner controls the project and decides who receives a contributor link. Contributor links are designed to be difficult to guess, but they are shareable access links and are not a substitute for individual sign-in access controls. Do not share a contributor link with people you do not intend to invite.
Project owners may close contributions. When a project is closed for checkout or otherwise locked, contributors may no longer submit content and the owner may no longer edit the book until Moments permits it to be reopened under the applicable order state.
Your Content and Permissions
"Your Content" includes project details, messages, signatures, names, photos, captions, recipient information, and other information or material you submit through the Service.
You retain ownership of Your Content. You grant Moments a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, format, render, transmit, print, ship, and otherwise use Your Content as necessary to operate, secure, support, and provide the Service and fulfill your requested book order.
You represent and warrant that:
- You own Your Content or have all rights, permissions, releases, and consents necessary to submit it and grant the license above.
- Your Content does not infringe, misappropriate, or violate another person's intellectual-property, privacy, publicity, or other rights.
- You have consent from every identifiable person depicted in Your Content when that consent is required, including consent from a parent or guardian for a minor.
- Your Content is accurate to the extent it includes shipping, recipient, or order information.
Contributors understand that their submitted content is available to the project owner and may be included in a book for the intended recipient. Project owners are responsible for reviewing the assembled book and deciding which contributions are included in print.
Public Asset URLs and Final Materials
Photos and generated previews or PDFs may be stored at public URLs that are difficult to guess but are not protected by individual sign-in access controls. Anyone who obtains a public asset URL may be able to access that asset. Do not share asset URLs with people you do not intend to have access.
Books that have been printed, delivered, downloaded, or shared cannot be recalled or removed from another person's possession.
Acceptable Use
You may use the Service only for lawful, personal, and non-commercial purposes unless we agree otherwise in writing. You must not:
- Submit content that is unlawful, infringing, threatening, harassing, hateful, defamatory, fraudulent, deceptive, or otherwise harmful.
- Submit non-consensual intimate imagery, child sexual abuse material, sexualized depictions of minors, content that exploits or endangers minors, or personal information intended to expose or harm another person.
- Impersonate another person or falsely claim an affiliation.
- Upload malware or interfere with, disrupt, overload, probe, scrape, or bypass security or access controls for the Service.
- Use automated means to harvest information, contributor links, or content from the Service.
- Use the Service in a way that violates applicable law or another person's rights.
We may investigate, remove or refuse to process content, suspend access, refuse to print or fulfill an order, or take other appropriate action when we reasonably believe these Terms or applicable law have been violated.
AI-Assisted Features and Photo Enhancement
The Service may offer optional AI-assisted writing tools and photo-resolution enhancement. If you choose to use an AI-assisted feature, relevant text may be processed through our service providers to generate the requested result. Photo enhancement may send an image URL to the provider performing the enhancement.
AI-generated content may be inaccurate, incomplete, or unsuitable. You are responsible for reviewing and editing all generated suggestions before using them in a project or order. We do not guarantee that AI-generated content is unique, accurate, available, or appropriate for a particular purpose.
Our processing of personal information through AI-assisted features and photo enhancement is described in our Privacy Policy.
Orders, Payment, and Shipping
Prices, taxes, shipping options, delivery estimates, and product availability are shown during checkout and may change before an order is submitted. You are responsible for providing accurate order, recipient, and shipping information.
Payments are collected through Stripe-hosted Checkout. Moments does not receive your payment-card number. By placing an order, you authorize the payment processor to charge the amount shown at checkout, including applicable taxes and shipping charges.
Printed books are currently available for delivery only to addresses in the United States. Shipping options and estimates depend on the destination and the print provider's availability. Delivery estimates are estimates, not guarantees.
Before checkout, you must review the current book preview. A project may be locked for checkout only after Moments confirms that the printable book artifacts are current and ready for production.
Printing, Cancellations, and Refunds
Each book is made to order. Small differences in color, trim, and binding can occur between printed copies and are a normal part of the printing process.
You may request cancellation before printing begins. A cancellation is effective only if our print provider confirms it. Once printing has begun, we cannot guarantee cancellation.
Our Refund Policy is incorporated into these Terms and governs refund requests. If these Terms and the Refund Policy conflict as to a refund or cancellation, the Refund Policy controls.
Moments Intellectual Property
The Service, including its software, design, logos, templates, and other content provided by Moments, is owned by Moments or its licensors and is protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, we reserve all rights not expressly granted to you.
You may not copy, modify, distribute, reverse engineer, or create derivative works from the Service or its software except as applicable law permits or we authorize in writing.
Third-Party Services
The Service relies on third-party providers, including providers for authentication, storage, payments, printing and fulfillment, email, hosting, analytics, error monitoring, AI-assisted features, and photo enhancement. Your use of a third-party service may be subject to that provider's terms and privacy practices. We are not responsible for third-party services, including their availability, acts, omissions, or content.
Privacy
Our Privacy Policy explains how we collect, use, share, retain, and protect personal information. It is incorporated into these Terms.
Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." Moments does not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times, or that any preview, AI-generated result, shipping estimate, or third-party service will be accurate, complete, timely, or suitable for your needs.
We are not responsible for Your Content, other users' content, printer or carrier delays, or losses caused by inaccurate recipient, shipping, or order information supplied by you.
Limitation of Liability
To the maximum extent permitted by law, Moments and its affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities, arising from or related to the Service or these Terms.
To the maximum extent permitted by law, Moments' total liability for any claim arising from or related to the Service or these Terms will not exceed the amount you paid to Moments for the order or Service giving rise to the claim during the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Moments and its affiliates, officers, employees, agents, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from Your Content, your use of the Service, or your violation of these Terms, applicable law, or another person's rights.
Governing Law and Venue
These Terms and any dispute arising from or related to the Service are governed by Utah law, without regard to conflict-of-law rules. Any dispute that is not resolved informally must be brought exclusively in the state or federal courts located in Utah, and you and Moments consent to those courts' jurisdiction and venue.
General Terms
These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and Moments regarding the Service. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them as part of a merger, acquisition, financing, reorganization, or sale of assets.
